By accessing or using Face2Bae (the "Service"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Service.

2. Description of Service

Face2Bae uses artificial intelligence to generate hypothetical images of potential romantic partners based on your uploaded photo, then matches those generated images against a database of real people. This is an experimental service for entertainment purposes.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years old.

4. User Content and Licenses

Your Uploads: When you upload a photo, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display that photo solely for the purpose of providing the Service (generating your hypothetical match and creating embeddings for matching).

Your Responsibilities: You represent and warrant that:

• You own or have permission to upload any photos you submit
• Your photos do not violate any third party's rights
• Your photos do not contain illegal content
• You are the person depicted in your uploaded photo

Our Rights: We reserve the right to remove any content that violates these Terms or that we find objectionable.

5. AI-Generated Content

No Guarantees: The AI-generated images are hypothetical and for entertainment only. We make no representations about:

• The accuracy, realism, or appropriateness of generated images
• Whether you will actually be compatible with any matched individuals
• The availability or interest of matched individuals

Biases: AI models may reflect biases present in their training data. Generated images may not reflect your actual preferences or compatible partners.

6. Matching Service

No Guarantees of Results: We do not guarantee:

• That you will find a romantic partner
• That matched individuals will be interested in you
• That matched individuals are available or single
• The accuracy of any match scores or compatibility metrics

Third Party Images: Our database includes publicly available images of public figures (actors, politicians, business people). We do not represent or warrant that these individuals:

• Have consented to be in our database
• Are available for dating
• Would have any interest in being contacted

7. Prohibited Conduct

You agree not to:

• Upload photos of other people without permission
• Upload photos of minors
• Use the Service to harass, stalk, or harm others
• Attempt to reverse engineer or scrape the Service
• Use the Service for any illegal purpose
• Upload explicit, violent, or otherwise inappropriate content

8. Privacy and Data Usage

See our separate Privacy Policy. We do not sell your data or use it for advertising purposes outside this app.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI-generated images will be appropriate or accurate
• Matches will lead to romantic relationships
• The Service will meet your expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the Service
• Any AI-generated content
• Any matches or lack thereof
• Any interactions with other users or matched individuals
• Any unauthorized access to your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these Terms
• Your violation of any third party rights

12. Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

You may delete your account at any time through the Service settings.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Face2Bae.
